1. Who we are

Express Legal Funding (“we,” “us,” “our,” or “ELF”) provides pre-settlement legal funding to plaintiffs with pending personal-injury and other litigation. This mobile application (the “App”) lets prospective applicants estimate a payoff at the time of settlement and submit an inquiry to our intake team.

2. The short version

  • We collect personal information from you only when you tap “Submit application” on the Apply screen.
  • We do not intentionally collect anything from the Calculator screen or the Saved screen unless you choose to submit an application — those run entirely on your device.
  • We do not use ads, third-party analytics, tracking pixels, or device advertising identifiers.
  • We do not knowingly collect information from anyone under 18.
  • We share submitted applications with our internal intake team via secure internal communication systems with our standard service providers (e.g., funding underwriters and case-management vendors). We do not sell your personal information.

3. Information we collect

3.1 Information you provide

When you submit the Apply form, we receive the information you typed in: - Full name - Phone number - Email address - Case type - Expected settlement amount (optional, approximate) - Attorney or firm (optional) - Free-text notes you choose to share

3.2 Information generated automatically

We attach the following to each submission so we can triage: - The platform you submitted from (iOS or Android) - A timestamp - The fact that the submission came from the mobile App (rather than our website)

3.3 Information stored on your device only

  • Saved scenarios. When you tap “Save scenario” on the Calculator, the inputs and computed payoff are stored locally on your phone in AsyncStorage. We have no copy of these scenarios — they never leave your device unless you choose to share them outside the App. Uninstalling the App removes them.

3.4 Information we do not collect

  • We do not collect your precise location.
  • We do not access your contacts, photos, microphone, or camera.
  • We do not use cookies (a web concept that does not apply to a native mobile app).
  • We do not embed third-party advertising or analytics SDKs.
  • We do not collect any information until you tap “Submit” on the Apply screen.

4. How we use your information

We use the information you submit to: - Review your inquiry and decide whether to extend a funding offer - Contact you about your application and any follow-up questions - Verify identity, case status, and attorney representation, where applicable - Comply with our legal obligations (recordkeeping, audits, disputes) - Detect and prevent fraud, abuse, or misuse of the App - Improve our internal processes

We do not use your information to train AI models, sell to advertisers, or build a marketing profile of you.

The calculator provided in the App is for informational purposes only. Any payoff estimates, projected repayment amounts, or settlement calculations are hypothetical estimates based solely on the information you enter and assumptions built into the App. Actual funding terms, fees, repayment obligations, eligibility determinations, and approval decisions may differ materially after review of your case, attorney information, and supporting documentation. Use of the calculator does not constitute a loan offer, funding commitment, or approval decision.

5. How we share your information

We share information only as needed to provide our funding service:

  • Internal team. Submissions are routed to our intake specialists via Slack so we can respond quickly. Slack acts as a data processor on our behalf — see Slack’s privacy practices at https://slack.com/trust/privacy/privacy-policy.
  • Service providers. We may share information with underwriters, case-management systems, document custodians, payment processors, and similar vendors who help us evaluate and fund cases. These providers are contractually limited to using your information for the specific service they perform for us.
  • Your attorney. If you tell us who your attorney is, we may contact them to verify case status with your consent.
  • Legal compliance. We may disclose information if required by law, subpoena, or court order; to enforce our agreements; or to protect the rights, property, or safety of any person.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred to the acquiring entity, subject to the protections of this Policy.

We do not sell your personal information and do not share it for cross-context behavioral advertising.

6. Where your information is processed

Information is processed in the United States. If you submit from outside the United States, your information will be transferred to and stored in the United States, where data-protection laws may differ from those of your country.

7. How long we keep your information

We retain submitted applications and any resulting case records for as long as needed to provide funding services and to comply with our recordkeeping and tax obligations. Inactive inquiries are typically retained for 36 months before being deleted or anonymized.

8. How we protect your information

We use commercially reasonable administrative, technical, and physical safeguards to protect submitted information. The App sends submissions over an encrypted HTTPS connection. We restrict internal access to staff who need it to do their jobs. No system is perfectly secure, however, and we cannot guarantee absolute security.

9. Your privacy rights

Depending on where you live, you may have the right to: - Know what personal information we have about you - Access a copy of that information - Correct inaccurate information - Delete your information (subject to legal retention requirements) - Opt out of certain sharing - Appeal a denial of your request

To exercise these rights, email privacy@expresslegalfunding.com with your full name and the email address you used in the App. We will verify your identity before responding. We respond within the timeframe required by your state’s law (typically 45 days).

We do not discriminate against you for exercising these rights.

California (CCPA / CPRA)

California residents have the right to know, delete, correct, limit use of sensitive personal information, and opt out of sale or sharing for cross-context behavioral advertising. We do not sell personal information or share it for cross-context behavioral advertising. The categories of personal information we collected in the last 12 months are listed in Section 3.

EU / UK (GDPR)

If you are in the European Economic Area or the United Kingdom, our legal bases for processing your information are (a) your consent (when you submit the form), (b) the necessity of processing to take steps at your request before entering into a contract, and (c) our legitimate interests in operating and improving our business and preventing fraud.

10. Children’s privacy

The App is not directed to children under 18. We do not knowingly collect information from anyone under 18. If you believe we have inadvertently collected information from a child, please email privacy@expresslegalfunding.com and we will delete it.

12. Changes to this Policy

We may update this Policy from time to time. When we do, we will update the “Last Updated” date at the top. For material changes, we will provide notice via the App or by email before the change takes effect.
